Abstract
En el artículo se analiza el contenido normativo y la operación práctica de la veda electoral en Puerto Rico, la cual impide que las entidades gubernamentales utilicen fondos públicos para generar una ventaja indebida a favor de un partido o candidato(a) en el proceso electoral. Específicamente, se estudian las disposiciones constitucionales y estatutarias que componen la veda electoral, incluyendo sus prohibiciones sustantivas, excepciones particulares y mecanismos de implementación.
Este esquema adopta una definición amplia del concepto de comunicación gubernamental y de fondos públicos, mientras que las excepciones se conciben de forma específica y estrecha. A su vez, la veda electoral adopta diferentes mecanismos de implementación, dependiendo de la inminencia de un evento electoral en el país. De igual forma, se presenta una mirada integral de todas las disposiciones jurídicas aplicables, de forma que se tenga un mejor entendimiento de este esquema normativo abarcador y completo. Finalmente, se hacen propuestas de posibles desarrollos normativos y operativos.
[This article analyzes the normative content and practical operation of the electoral ban (electoral restrictions/ campaign restrictions) in Puerto Rico, which prevents government entities from using public funds to generate an undue advantage in favor of a party or candidate during the electoral process. It will specifically discuss the constitutional and statutory provisions that make up the electoral ban, including their substantive prohibitions, particular exceptions, and implementation mechanisms.
This scheme adopts a broad definition of the concept of government communication and public funds, while the exceptions are specifically and narrowly conceived. In turn, the electoral ban adopts different implementation mechanisms, depending on the imminence of an electoral event in the country. Likewise, an integral view of all applicable legal provisions is presented, with the purpose of providing a better understanding of how this regulatory scheme was developed. Finally, proposals for possible future regulatory and operational developments are discussed.]
