Abstract
La máxima de minimis non curat lex establece que el derecho no se preocupa por nimiedades. Como consecuencia, ciertas conductas y actos que, nominalmente, estarían cobijados por alguna norma jurídica, quedan excluidos de la aplicación de dicha norma por tratarse de un asunto que no lo amerita. En Puerto Rico, esta máxima se ha utilizado por décadas, pero nunca se había estudiado su contenido normativo, desarrollo histórico y áreas de aplicación.
Con este Artículo, exploramos las interioridades de esta figura, tanto a nivel conceptual como en su aplicación en el ordenamiento jurídico puertorriqueño. Se trata de una figura que existe tanto en el derecho civil como en el common law, pero que se ha desarrollado de forma autóctona en Puerto Rico, tanto a nivel de derecho positivo como en la jurisprudencia.
[The maxim de minimis non curat lex states that the law does not concern itself with trifles. As a result, certain conduct and actions that would, nominally, fall under a particular legal rule, would be excluded from the application of that rule. In Puerto Rico, this maxim has been used for decades, but its normative content, historical development or areas of application have not been studied. With this Article, we explore the inner workings of this legal concept, both at the conceptual level, as well as its use in the Puerto Rican legal system. We are dealing with a concept that exists both in the civil law and the common law, but that has been developed in Puerto Rico in an indigenous manner, both in positive law and case law.]
