Abstract
En este artículo se analizan quince decisiones del Tribunal Supremo de los Esta- dos Unidos que tienen un impacto directo en Puerto Rico. Estas decisiones atien- den un sinnúmero de temas jurídicos trascendentales, como la libertad religiosa y el discrimen, el derecho al voto, la libertad de expresión política, la Cláusula de Comercio y los impuestos estatales a las transacciones por internet, el derecho a cuestionar la constitucionalidad de un estatuto penal a pesar de declararse cul- pable, el derecho a insistir en su propia inocencia cuando un abogado o abogada expresa lo contrario, el alcance de la intimidad en los teléfonos celulares y vehí- culos alquilados, así como el derecho de los empleados públicos que deciden no sindicalizarse a no sufragar el costo de administrar el convenio colectivo. Ade- más de ofrecer una discusión individual de cada decisión, de forma que se tenga un entendimiento completo del desarrollo doctrinal y normativo de estas, este artículo incluye un análisis integrado sobre las últimas tendencias en el Tribunal Supremo federal, con miras a ir identificando en qué dirección irá dicho foro en el futuro inmediato. Esto, como parte de un esfuerzo por mantener informado a la comunidad jurídica en Puerto Rico sobre los acontecimientos recientes más importantes en el derecho federal.
This article analyzes fifteen decisions by the Supreme Court of the United States that have a direct impact in Puerto Rico. These decisions cover any important legal issues, such as religious liberty and discrimination, the right to vote, politi- cal speech, the Commerce Clause and state taxes over internet transactions, the right to challenge the constitutionality of a criminal state after pleading guilty, the right to insist on one’s own innocence when one’s attorney expresses the op- posite, the scope of privacy in cell phones and rented cards, as well as the right of public employees who choose not to join a union to not subsidize the administra- tion of the collective bargaining agreement. In addition to offering an individual discussion of each decision, so that we can have a better understanding of their doctrinal and normative rulings, this article includes an integrated analysis of the latest tendencies of the federal Supreme Court, with the goal of identifying in which direction that body will take in the near future. This, as part of an effort to keep the legal community in Puerto Rico informed about the most important latest events in federal law.
